Terms of Service

These terms apply when you use therealmrtea.com, buy tea, book a ticket to one of our classes, or hire the mobile tea cart. By placing an order or booking you agree to them, so please read them. If anything is unclear, email ryan@therealmrtea.com and we will explain.

Who we are

The Real Mr. Tea, Mt. Washington, Kentucky 40047, United States. "We" and "us" mean The Real Mr. Tea; "you" means the person using the site or placing an order.

Orders and pricing

• All prices are in US dollars and exclude any applicable sales tax, which is calculated at checkout.
• Placing an order is an offer to buy. The contract is formed when we send your order confirmation email.
• We may refuse or cancel an order, including after confirmation, if an item is out of stock, a price or description was wrong, payment fails, or we suspect fraud. If we cancel after you have paid, we refund you in full.
• Product photographs are representative. Loose leaf tea is a natural product, so the exact appearance of a blend varies between batches.

Payment

Payments are processed by Stripe. We do not receive or store your card number. By paying you also accept Stripe's terms. Your order ships once payment has cleared.

Shipping and delivery

• We ship within the United States only.
• Free shipping on orders over $50. Otherwise a flat rate of $5.99.
• Free local delivery to the Mt. Washington 40047 ZIP code.
• We aim to dispatch within two to three business days. Delivery estimates are estimates, not guarantees, and we are not responsible for carrier delays.
• Risk of loss passes to you on delivery to the carrier. Please give us a correct address: we cannot be responsible for a parcel sent to an address you entered incorrectly.

Returns and refunds

Tea and other consumables

Tea, and any other food or drink product, is non-returnable and non-refundable. This is a food-safety measure: once a consumable product has left our control we cannot verify how it has been stored, so we cannot resell it or accept it back.

That said, we will always make it right if something is wrong. If your order arrives damaged, if we sent the wrong item, or if anything is not as it should be, email ryan@therealmrtea.com within 14 days of delivery with your order number and a photo. We will replace it or refund it.

Event tickets

Tickets are handled case by case. If you can no longer attend, email us as early as you can and we will do our best, whether that is a refund, a transfer to a later class or passing your seat to someone else. The earlier you tell us, the more we can do, because a seat released late usually cannot be filled.

If we cancel or reschedule an event, you may take a full refund or move to the new date, as you prefer.

Mobile tea cart bookings

Event bookings are covered by the written quote and any deposit terms agreed at the time of booking, which take precedence over this section.

Event tickets and attendance

• Seats are limited and sold first come, first served. Your seat is reserved while you complete checkout and released if payment is not completed.
• Your confirmation email contains a confirmation code. Please have it with you.
• For virtual tickets we post your tea to the address you give at checkout and email you the joining link. Please register far enough ahead for the post to reach you.
• Classes may be photographed or filmed for social media. Tell us on the day if you would rather not appear and we will respect that.
• Please tell us about allergies or dietary requirements before the class. Our teas are handled in a facility that also handles nuts, dairy and other allergens.

Wholesale

Wholesale pricing is available to approved businesses. Applications are reviewed individually and approval is at our discretion. Wholesale orders may be subject to a minimum order value, shown at checkout. Wholesale pricing is for resale or business use, not for personal purchases.

Accounts

You are responsible for keeping your password secure and for activity on your account. Tell us promptly if you believe it has been compromised. We may suspend or close an account that is used fraudulently or in breach of these terms.

Reviews and submissions

Reviews must be your honest experience of a product you bought. We moderate before publishing and may decline anything false, abusive, off-topic or promotional. By submitting a review you give us permission to publish it on the site and in marketing, alongside the display name you chose.

Health information

Anything we write about tea on this site is general interest, not medical advice. Our products are not intended to diagnose, treat, cure or prevent any disease. If you are pregnant, nursing, taking medication or managing a health condition, talk to your doctor before making significant changes to what you drink. Several of our blends contain caffeine.

Our content

The text, photographs, logos and design on this site belong to The Real Mr. Tea and are protected by copyright and trademark. You may not copy or reuse them commercially without our written permission. You are very welcome to share links to our pages.

Acceptable use

Please do not attempt to break into the site, scrape it automatically, interfere with its operation, or use it for anything unlawful.

Limitation of liability

We provide the site and our products with reasonable care, but to the fullest extent the law allows we exclude implied warranties and are not liable for indirect or consequential loss. Our total liability for any claim is limited to what you paid us for the order or booking the claim relates to. Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence.

Governing law

These terms are governed by the laws of the Commonwealth of Kentucky, and the courts of Bullitt County, Kentucky have jurisdiction over any dispute. Before going to court, please email us: almost everything is quicker to resolve directly.

Changes

We may update these terms. The version in force when you place an order is the version that applies to it. The effective date at the top shows when this version took effect.
